Private Right of Action in CASL – Postponed

Minister Bains has announced that the Private Right of Action in Canada’s Anti-spam Legislation (CASL) is postponed indefinitely. See the attached news release here.

The provisions, known as private right of action, would have allowed lawsuits to be filed against individuals and organizations for alleged violations of the legislation. The provisions were scheduled to come into force on July 1, 2017, but have now been suspended.

Debate on the issue will take place during the forthcoming Parliamentary Review of CASL which is yet to be scheduled, but could begin as early as this Fall.
